Welcome to the Hart International website (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Site and the purchase of products or services. By using the Site or making a purchase, you agree to be bound by these Terms.

1. General Terms

1.1 Acceptance of Terms: By using this Site, you affirm that you are at least 18 years of age or accessing the Site under the supervision of a parent or legal guardian.

1.2 Modifications: Hart International reserves the right to modify or update these Terms at any time without prior notice. Continued use of the Site after such changes will signify your acceptance of the updated Terms.

1.3 Use of the Site: You may access the Site solely for personal and non-commercial use. Any resale, distribution, or unauthorized use of the Site's content, products, or services is prohibited.

2. Account Registration

2.1 Accuracy of Information: When creating an account on our Site, you agree to provide accurate, current, and complete information.

2.2 Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Hart International is not responsible for unauthorized access or use of your account.

2.3 Termination: We reserve the right to terminate or suspend your account if we suspect any fraudulent activity or violation of these Terms.

3. Orders and Payments

3.1 Order Acceptance: All orders are subject to acceptance. We reserve the right to refuse or cancel any order for any reason, including stock availability, pricing errors, or suspected fraud.

3.2 Pricing and Availability: Prices and availability of products are subject to change without notice. We strive to display accurate pricing, but errors may occur. In the event of a pricing error, we will notify you and provide an option to confirm the order at the correct price or cancel it.

3.3 Payment Method: Dragonpay is the sole payment method accepted on our Site. By submitting an order, you authorize us and Dragonpay to charge your payment method. All transactions are encrypted and securely processed by Dragonpay.

3.4 Dragonpay Terms:

Dragonpay shall process all instructions received using the information you provide. You accept full responsibility for all transactions processed using such information, whether or not processed with your knowledge or authority.
Dragonpay acts solely as a third-party payment processor. The terms and conditions of the product or service you purchase using Dragonpay’s facility are strictly between you and Hart International.
Hart International shall not be held liable for the failure to deliver a product or service as advertised. You hereby release and hold harmless Dragonpay from all liability arising from the product or service purchase. All liability shall reside with Hart International.
Dragonpay is not responsible for any charges imposed by Hart International or any action taken against you for non-processing of payments due to your failure to follow payment instructions.
Dragonpay shall not be liable for delays in processing payments due to system problems, internal maintenance, or maintenance with payment collection partners.
All payments made using Dragonpay are final and executory. However, Dragonpay reserves the right to not process a transaction due to internal reasons. Refunds may be subject to Dragonpay’s discretion.
Your access to Dragonpay through third-party network providers is subject to their respective terms and conditions. The security of data transmitted through such networks is covered by their governing policies.
Any excess portion of your payment will be forfeited. Payments less than the amount due will not be processed.

4. Shipping and Delivery

4.1 Shipping Policy: Shipping times and costs may vary based on location and the chosen delivery method. We aim to dispatch your order promptly, but we are not responsible for delays caused by couriers, shipping partners, or circumstances beyond our control.

4.2 Risk of Loss: Once we hand over your order to the courier, Hart International shall not be held liable for any loss, damage, or delays that occur during shipping. The risk of loss or damage passes to you upon dispatch of the item to the courier. Any claims for loss, damage, or delays during transit should be directed to the courier or shipping provider.

4.3 International Shipping: For international orders, customers are responsible for any applicable customs fees, taxes, or duties. Hart International is not responsible for delays or issues caused by customs inspections or procedures.

5. Product Returns and Replacement Policy

5.1 Product Returns and Replacement Policy:
In compliance with Republic Act No. 7394, or the Consumer Act of the Philippines, Hart International enforces a Product Returns and Replacement Policy for all products sold on our e-commerce platform. Products are not eligible for return or exchange unless they are defective, damaged, or do not meet the advertised specifications.

5.2 Defective or Damaged Products:
If the product you received is defective, damaged, or does not conform to its advertised description, you are entitled to request a replacement or refund. All claims must be made within 7 days from receipt of the product, and you must provide a video recording of the unboxing or unpacking of the item, clearly showing the defect or damage.

No video, no refund: Claims without video evidence of the product being opened will not be eligible for refund or replacement.
Products eligible for replacement must be returned in their original packaging.
Hart International will not cover the cost of returning defective or damaged items. Shipping costs for returning such products must be borne by the customer.

5.3 Exceptions to Product Returns and Replacement Policy:

Under RA 7394, or the Consumer Act of the Philippines, the Product Returns and Replacement Policy will not apply in the following cases:

Change of mind: Products cannot be returned or exchanged simply because the customer has changed their mind about the purchase.
Non-defective products: Items that are not defective, damaged, or do not conform to advertised specifications cannot be returned.
Failure to follow care instructions: Products that are damaged due to improper handling or failure to follow care and usage instructions are not eligible for return or replacement.
Normal wear and tear: Products that show damage or deterioration due to regular usage or natural wear and tear over time are not eligible for return or exchange.

5.4 Final Sale Items:
Certain items (e.g., sale items, promotional items) are considered final and are not eligible for returns or exchanges, unless the product is defective or damaged.

5.5 Procedure for Returns:
To initiate a return or exchange for defective or damaged products, please contact our customer service team at web@hartintl.com. You will be required to provide your order number, description of the issue, and the video evidence of the unboxing. We will evaluate the claim and provide instructions on how to return the item.

6. Intellectual Property

6.1 Ownership: All content, including text, images, logos, and graphics on the Site, is the property of Hart International or its licensors and is protected by intellectual property laws.

6.2 Prohibited Use: You may not copy, reproduce, distribute, or otherwise use any content from this Site without our express written permission.

7. Limitation of Liability

7.1 No Warranties: All products and services provided by Hart International are "as is" and without any warranties, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Limitation of Damages: Hart International shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid for the product or service in question.

8. User Content and Reviews

8.1 User-Generated Content: By submitting any reviews, comments, or content to our Site, you grant Hart International a non-exclusive, royalty-free, and worldwide license to use, reproduce, and distribute your content for promotional and marketing purposes.

8.2 Content Moderation: We reserve the right to remove or modify any user content that we deem inappropriate, offensive, or in violation of these Terms.

9. Privacy

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Philippines, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
